CHILDREN'S ONLINE PRIVACY

Note to Parents, Teachers and Children

Parents and Teachers: When using this Service, we encourage parents, guardians and teachers to spend time with their children, especially if the child is 12 and under (“Child” or “Children”). We will never request personally identifiable information from a Child in any public postings areas. We will not require a Child to disclose more personally identifiable information than is reasonably necessary to participate in any online activity.

Children's Online Privacy Protection Act

Our collection of personal information on Services that may be directed to children under 13 is intended to follow the principles of the Children's Online Privacy Protection Act ("COPPA"), a U.S. law designed to protect the online privacy of children under the age of 13.

Here are some examples of personal information we may ask of children using our Services: first name, surname, age, grade, areas in which they would like academic help, details of homework assignments for which they seek assistance, email address, parents' name and email address.

Notification and Verifiable Parental Consent

We will obtain verifiable parental consent before asking for personal information on Services directed to children under 13, unless the request for information falls within an exception that would be permitted under COPPA. Parents will have the option to consent to the collection of the Child's information without consenting to the disclosure of the information to third parties.

Notification to parents will include the exact nature and intended use of the information we are collecting, as well as the opportunity for the parent or guardian to prevent the use of the information and the Child's participation in the activity. For every Child, we will also require the parent or guardian to provide verifiable parental consent such as: by email plus a fax, phone or letter follow up by the parent or guardian; mail, fax or scan of a consent form; or toll-free phone call to Tomorrow's Genius; or other acceptable method.

In order for us to provide notice to a parent or guardian and seek verifiable parental consent, we may request the online contact information of a parent or guardian. This contact information will only be used for the sole purpose of obtaining verifiable parental consent or providing notification to the parent or guardian.

We do not make personal information collected from children publicly available nor do we enable children to do so through our Services. We will not condition a Child's participation in any activity or Service on the disclosure of more personal information than is reasonably necessary to participate in an activity.

Parents may contact us (at [email protected]) to review, update or delete any of their children's personal information that we may have collected and to elect for us not to collect any additional personal information from their children.

Exceptions to Verifiable Parental Consent

In the following instances we will not get verifiable parental consent for the collection of a Child's personal information:

  1. When users of our Services directed to children wish to sign up to receive our email newsletters, we will ask for a parent's first name and email address. We will send a notification email to the parent and give the parent the option to decline the newsletter. If the newsletter is declined, we will not send the newsletter and will delete from our files any related personal information collected in the sign-up process. If the newsletter is not declined, we will send the newsletter. All newsletters contain instructions so that the recipient may unsubscribe at any time.
  2. If a Child voluntarily submits personal information through a “Contact Us“ link or otherwise to one of our Services and we can identify the sender as a Child, we will only use any personal information submitted to respond to the Child on a one-time basis. In addition, if we have actual knowledge that a Child is sending personal information to any of our Services, we will use commercially reasonable efforts to delete such personal information as soon as practicable.
  3. A Child may provide the email address of their parent or guardian for the purpose of retrieving or resetting a Child's lost password for their user account. A parent or guardian's email address collected in this instance will only be used for this purpose.

SERVICE PROVIDERS

We contract with third parties, such as teachers and other service providers ("our Service Providers"), to provide certain services or to facilitate the operations of our Services. Our Service Providers will be given access to your information only as is reasonably necessary to provide the services for which they are contracted. They will be required to abide by the terms of this Privacy Policy in their handling of personal information.

WebEx

Some of our Services that provide online courses or conferencing use WebEx. Your registration information is collected by WebEx and communicated to us in a secure and confidential manner. WebEx has its own privacy policy, and we invite you to review that privacy policy at http://www.cisco.com/web/siteassets/legal/privacy.html. We may record WebEx sessions and retain those recordings for internal use.

STORING THE INFORMATION WE COLLECT
